1. About these terms

These terms govern your use of arrealty.co (the “website”) and the advisory service we offer through it. By browsing the website or sending us an enquiry you agree to them, together with our Privacy Policy and Disclaimer. If you do not agree, please do not use the website. This document is an electronic record under the Information Technology Act, 2000 and needs no physical or digital signature.

2. Who we are and what we do

AR Realty is the name under which Naiman Afzal A R, a real estate agent registered with the Karnataka Real Estate Regulatory Authority (Agent Reg. No. PRM/KA/RERA/1251/310/AG/231216/004348), carries on business in Bengaluru. We introduce home buyers to residential projects, share information and our own assessment of them, arrange site visits and help buyers and developers through booking. We are not a developer, builder, promoter, lender, law firm or financial adviser, and we do not own or sell the homes shown here.

3. Who may use this website

You must be at least 18 years old and able to enter into a contract under the Indian Contract Act, 1872. If you enquire on behalf of someone else, you confirm that you have their permission. Non-resident Indians and others buying from abroad are responsible for meeting the foreign-exchange and tax rules that apply to them.

4. Information only, not an offer

• Nothing on this website is an offer, an invitation to offer, a booking, an allotment or a promise to sell any property.
• You cannot buy, reserve or pay for a home on this website. A purchase takes place only when you and the developer sign the developer's application form and agreement for sale, on the terms in those documents.
• Those documents, and the details the developer has filed with K-RERA, override anything on this website.

5. Our fees

Home buyers do not pay us brokerage or any other fee for our advice or for site visits. When a sale we have facilitated completes, the developer pays us a commission. Sending an enquiry does not create an agency, partnership, employment or fiduciary relationship between you and us, and it does not oblige you to buy.

6. Enquiries, calls and site visits

• Give accurate, current details that are your own or that you have permission to share.
• By submitting a form you ask us to contact you, and you agree to receive calls, SMS, WhatsApp messages and emails from us about your enquiry and related projects, even if your number is on the National Customer Preference Register (“Do Not Disturb”). You can stop this at any time; see our Privacy Policy.
• A site-visit request is a request, not a confirmed appointment, until we confirm the date and time with you.
• Construction sites can be dangerous. On a visit, follow the developer's safety instructions, stay with your escort and look after children. You visit at your own risk.
• Developers decide which agent is credited with a buyer, usually by who registered the buyer first. If you have already registered with the developer directly or through another agent, tell us.

7. Payments

We do not collect booking amounts, instalments or any other payment for a property, online or offline. Make every payment for a home only to the developer, by cheque, demand draft or bank transfer in the developer's name, into the project account it has designated, and insist on the developer's receipt. If anyone asks you to pay AR Realty, or an individual, for a property, do not pay and tell us at sales@arrealty.co.

8. Accuracy of information

We take project details from developers' published material, K-RERA records and other sources named on each page, and we check them. Prices, availability, plans, specifications, approvals and dates change, often without notice, and errors can occur. We do not promise that the website is complete, current or free of mistakes. Our scores, verdicts and comparisons are opinion. The calculators give estimates. Read our Disclaimer, and confirm anything important with us and with the developer before you commit.

9. Acceptable use

You agree not to:

• submit false, misleading or someone else's details, or automated or bulk enquiries;
• copy, scrape or republish the website or a substantial part of it without our written permission;
• present our analysis, scores or text as your own, or use them to advertise property;
• interfere with the website, probe it for weaknesses, or introduce malicious code;
• use the website for anything unlawful, or in a way that harms us, developers or other users.

We may block access or ignore enquiries that break these rules.

10. Ownership and trademarks

The website's design, text, scores, analysis, calculators and the AR Realty name and logo belong to us. You may view and print pages for your own home search. Developer and project names, logos, images, plans and brochures belong to their owners and appear here only to identify the projects we advise on; their use does not mean that a developer sponsors or endorses this website. Photograph credits are on our credits page. If you believe something here infringes your rights, write to sales@arrealty.co and we will review it promptly.

11. Third-party content and links

The website shows news headlines supplied by Google News and links to developers, K-RERA, publishers and map services. We do not control that content, do not endorse it and are not responsible for it or for those sites' privacy practices. Opening a link is at your own risk.

12. No warranties

The website and its content are provided “as is” and “as available”. To the extent the law allows, we give no warranty, express or implied, about accuracy, completeness, fitness for a particular purpose, uninterrupted access or freedom from viruses. We do not guarantee the quality, legal title, approvals, delivery date or future value of any project; those are the developer's responsibility.

13. Limit of liability

To the extent the law allows, we are not liable for any indirect or consequential loss, loss of profit or opportunity, or loss arising from your reliance on the website, from a developer's acts or omissions (including delay, changes to a project or cancellation), or from third-party sites and services. Nothing in these terms limits liability that cannot be limited by law, or takes away your rights under the Consumer Protection Act, 2019 or the Real Estate (Regulation and Development) Act, 2016.

14. Indemnity

You agree to compensate us for losses and reasonable costs that arise from your breach of these terms, your misuse of the website or your giving us false information or another person's details without permission.

15. Changes and availability

We may change, suspend or withdraw any part of the website, and may update these terms, at any time. The date at the top shows the latest version; continuing to use the website after a change means you accept it.

16. Governing law and disputes

These terms are governed by the laws of India. If you have a concern, please write to us first so we can try to resolve it. Subject to that, the courts at Bengaluru, Karnataka have exclusive jurisdiction. Complaints about a registered project or a registered agent may also be made to the Karnataka Real Estate Regulatory Authority at rera.karnataka.gov.in.

17. General

• If a court finds part of these terms unenforceable, the rest continues to apply.
• If we do not enforce a term at once, we may still enforce it later.
• We are not responsible for a failure caused by events outside our reasonable control, such as outages of hosting, network or third-party services.
• These terms, the Privacy Policy and the Disclaimer are the whole agreement between you and us about the website. If they conflict, the Disclaimer applies to project information and the Privacy Policy to personal data.
